Florida Summers Are Tough on Electric Vehicles
Florida heat is not gentle. Summer temperatures regularly push past 95 degrees Fahrenheit, and pavement temperatures can climb far higher. For electric vehicles, that heat is more than uncomfortable. It puts real stress on the battery pack and the systems designed to keep it cool.
When those cooling systems fail, the consequences can range from reduced range and slower charging to unexpected shutdowns and serious safety concerns. Many Florida EV owners are surprised to learn that a thermal management failure may qualify their vehicle as a lemon under state law.
What Is EV Thermal Management?
Every modern electric vehicle uses a thermal management system to keep the battery pack within a safe temperature range. This system typically includes liquid cooling loops, dedicated heat exchangers, software controls, and sometimes active heating for cold climates.
In Florida, the cold-weather side rarely matters. The cooling side matters enormously.
When the system works correctly, the battery stays within its operating range even during long drives, fast charging sessions, or extended exposure to the sun. When it fails, the vehicle's onboard software often steps in to protect the battery by limiting power output, capping charging speed, or shutting the vehicle down entirely.
Common thermal management problems Florida EV owners report include:
- Warning lights or alerts related to battery temperature
- Sudden loss of power or reduced acceleration in hot weather
- Charging speed that drops sharply or stops entirely at public fast chargers
- Range estimates that fall well below the advertised figure in summer heat
- The vehicle entering a "limp mode" or refusing to start after sitting in the sun
- Coolant leaks in the battery thermal circuit
- Repeated software updates that fail to resolve the underlying problem
Any of these issues can be frustrating. Some of them are also dangerous.
When Does a Thermal Problem Become a "Nonconformity"?
Florida's Lemon Law, Chapter 681 of the Florida Statutes, uses the word "nonconformity" to describe a defect or condition covered by the manufacturer's warranty that substantially impairs the use, value, or safety of the vehicle. Not every glitch rises to that level, but thermal management failures often do.
A vehicle that loses significant power on a Florida highway in July raises real safety concerns. A battery that routinely charges to only a fraction of its rated capacity impairs the vehicle's value and usefulness. Courts and arbitration panels look at whether a reasonable person would find the impairment substantial, not just annoying.
The law covers new vehicles and demonstrator vehicles sold or leased in Florida. It does not cover used vehicles. The window of protection runs for 24 months from the date of original delivery.
The Repair Attempt Process Under Chapter 681
The statute sets out a clear process before a consumer can seek a refund or replacement.
Three repair attempts for the same defect. If the manufacturer or its authorized dealer has had three attempts to fix the same thermal management problem and the issue persists, the consumer's next step is to send a written notice called a Motor Vehicle Defect Notification directly to the manufacturer. This notice gives the manufacturer one final opportunity to repair the vehicle. If that attempt also fails, the consumer may proceed.
Thirty or more cumulative days out of service. Some thermal problems require long diagnostic and repair periods. The statute also allows a claim when a vehicle has been out of service for repairs for 30 or more cumulative days during the Lemon Law rights period. For an EV with a complex cooling system failure, this threshold is reached more quickly than many owners expect.
If the days-out-of-service path applies, the consumer also sends written notice and allows the manufacturer a reasonable opportunity to inspect and repair the vehicle.

Keeping Records Is Critical
Documentation can make or break a thermal management claim. Many EV systems generate data logs, and dealers often perform software updates during service visits. Some of that data may be relevant to a claim.
Consumers who want to protect their rights generally do the following:
- Keep every repair order, even for visits that ended without a confirmed repair
- Note dates when the vehicle was dropped off and picked up
- Write down exactly what the vehicle was doing when the problem occurred, including outdoor temperature and whether fast charging was involved
- Request written confirmation of what the dealer diagnosed and what was done
- Save all communications with the dealer and manufacturer, including emails and text messages
It is also worth noting the mileage on each visit. Mileage can matter when calculating any statutory offset applied to a refund.
